Article 1 | The name of this organization is FEDERATION FOR A DEMOCRATIC CHINA,abbreviated as FDC(hereinafter refers to the Federation for a Democratic China); | |
Article 2 | The Federation for a Democratic China, as a non-profit organization, is registered in Paris, France, and its headquarter is located in the region where its President resides; | |
Article 3 | The Federation for a Democratic China is a political organization dedicated to advancing the process of democratization in China; | |
Article 4 | The Creed of the Federation for a Democratic China is:to defend basic human rights,to protect social justice,to develop private businesses,to end the one-party rule,and to build a democratic China; | |
Article 5 | The Guiding Principles of the Federation for a Democratic China, at this stage, are: peace, rationality and non-violence; | |
Article 6 | The Federation for a Democratic China advocates for political pluralism, the democratization of its organizations, and the openness of its factions are to be uphold within the internal departments of the Federation for a Democratic China. | |

Article 7 | All who identify to the Creed of ,and recognize to the Constitution of the Federation for a Democratic China,may voluntarily apply for membership,and through the Regional Divisions’, or Local Branches’ approval and submission to the headquarter for archiving purposes,may become official members of the Federation for a Democratic China. Applicants in regions that without a Regional Division or a Local Branch,may submit an application to the headquarter directly,and may become a member through approval; | |
Article 8 | Members are obligated to comply with the articles of the Constitution of the Federation for a Democratic China,and to make regular contributions by submitting annual membership fee; to defer a submission of a membership fee over one year without a reasonable explanation,is to be viewed automatically as leaving the Federation for a Democratic China; | |
Article 9 | Members have full suffrage includes the right to vote and stand to election,and may exercise their rights to vote,rights to question,rights to be heard and rights to quit; | |
Article 10 | The Federation for a Democratic China respects its members’ rights and independency,but members must not engage in activities in contrary to the Creeds and constitution of Federation for a Democratic China on behalf of the Federation for a Democratic China. | |

Article 11 | The Congress of the Federation for a Democratic China is responsible for the formulation and revision of the Federation for a Democratic China’s Creeds and Constitution; as well as the questioning, reviewing and approval process of the annual working reports submitted by General Council Board and Supervisory Committee of the Federation for a Democratic China. The Congress is responsible for the elections of the General Council Board and Supervisory Committee of the Federation for a Democratic China; | |
Article 12 | The Congress is to be held within every two years, and must not be held more than one month in advance of the last meeting, or more than 6 months postponed of the last meeting | |
Article 13 | The statutory valid number of members should be at least half of all current Congress members; | |
Article 14 | Unless otherwise specified, motions must meet a simple majority voting result within the Congress to become approved; | |
Article 15 | The amendments of this Constitution, will be approved if a two-third majority voting result is met within the Congress. | |

Article 16 | The General Council Board of the Federation for a Democratic China in responsible for drafting and reviewing strategic directions, operational plans, diplomatic policies, and finical budget of the Federation for a Democratic China, as well as the approval of intuitional settings and major personnel arrangements; the General Council Board is also responsible to submit annual working report to the Congress of Federation for a Democratic China, as well as the fomulation and modification of organization regulations and operational plans; | |
Article 17 | The General Council Board has nineteen to twenty-one board members and a number of alternate members, who are nominated in regional order by the Congress, and elected by a simple majority voting approval of the Congress. Board members are to be elected for a term of two years, and may be re-elected; | |
Article 18 | The Federation for a Democratic China have one President, and several vice-Presidents, who are to be nominated within the current board members of the General Council Board, and to be elected by a simple majority voting approval of the General Council Board of the Federation for a Democratic China, Presidential and vice-Presidential terms are two years, and may be re-elected; | |
Article 19 | The President is the only legal representative of the Federation for a Democratic China, and is responsible to convene General Council Board meetings, implement resolutions made by the General Council Board, and to maintain normal operations of the headquarter; vice-President is responsible for providing assistance to the President at work; while the president is not able to perform duties, a vice-President is to be assigned by the General Council Board to become the Acting President; | |
Article 20 | The Supervisory Committee is to be recognized as the monitoring body of the Federation for a Democratic China, The Supervisory Committee is responsible for processing disciplinary cases according to the Constitution; | |
Article 21 | The Supervisory Committee has nine committee members and a number of alternate members, who are nominated in regional order by the Congress, and elected by a simple majority voting approval of the Congress. The Supervisory Committee has a Chairperson and a vice-Chairperson, who are nominated within the Supervisory Committee, and elected by a simple majority voting approval of the Congress. Committee members, the Chairperson and the vice Chairperson are to be elected for a term of two years, and may be re-elected. The Supervisory Committee must organize for meetings annually. Whenever there is a dispute submitted to the Committee, or if more than one-third of the Supervisory Committee members make a joint requirement, the Chairperson of the Supervisory Committee must convene a Supervisory Committee meeting within one month, otherwise the vice-Chairperson should call the meeting. The statutory valid number of members of attendance should be above two-third of all members of the Supervisory Committee; | |
Article 22 | The General Council Board must organize for meetings annually, or if more than one-third of the board members make a joint requirement, the President of the Federation for a Democratic China must convene a General Council Board meeting within one month. Article 23 |
The impeachment of the Federation for a Democratic China’s President, vice-President,Chairperson and Vice-Chairperson of the Supervisory Committee, must only be effective after a two-third relative-majority voting approval voted by both the General Council Board and the Supervisory Committee synchronously and respectively. |

Article 24 | The Regional Divisions and Local Branches, should be set up, with the authorization of the headquarter, independently through a democratic process; | |
Article 25 | The representatives of Regional Divisions or Local Branches, must be elected within the certain Regional Division or Local Branch through a democratic process, and submit election results and statuses to the current headquarter for archiving purposes. | |

Article 26 | The dissolution of the Federation for a Democratic China and merging with other organizations, will be effective through a two-third relative-majority voting approval by the Congress of this organization; | |
Article 27 | The interpretation rights of this Constitution belong to the General Council Board. | |

This version of the Constitution was passed by the 13th global congress meeting of the Federation for a Democratic China held in Las Vegas, US on March 24th, 2017. It increased the number of members in both General Council Board and Supervisory Committee to 19-21 and 9, respectively, and also added a Vice-Chairperson for the Supervisory Committee. 本章程版本2000年12月8日于美国拉斯维加斯召开的民阵第十三次会员代表大会修改通过的章程全文。它将理事会和监事会的成员数量分别增加到19-21人和9人,分别设若干候补理事或监事,并增设了一名监事会副主席。 The original Constitution of the Federation for a Democratic China was published on the inaugural meeting of the Federation for a Democratic China held in Paris, France on September 22th, 1989. The original Constitution was amended respectively on the second global congress meeting of the Federation for a Democratic China held in Los Angeles, US during September 22th -24th, 1990, the third global congress meeting of the Federation for a Democratic Chinaheld in Melbourne, Australia during November 25th-28th, 1993 and the sixth global congress meeting of the Federation for a Democratic China held in Bonn, Germany on December 8th, 2000. The amendment of this Constitution made during the ninth global congress meeting of the Federation for a Democratic China held in Los Angeles, US on October 11th, 2008, changed the original content of the 21th article “The Supervisory Committee have seven committee members, the Supervising President is to be nominated by the General Council Board within the elected board members, and elected by a simple majority voting approval decided by the Congress, other six members of the Supervisory Committee are to be nominated by region within the Congress, and elected by a simple majority voting approval of the Congress. Committee members and are elected for a term of two years, and may be re-elected” to the all the members of Supervisory Committee should be nominated by region within the Congress, and the Supervising President should be nominated within the current Supervisory Committee. The amendment of this Constitution made during the eleventh global congress meeting of the Federation for a Democratic China held in Budapest, Hungary on October 8th, 2012, changed the original content of the article 17 “The General Council Board has 15 board members, who are to be nominated in regional order by the Congress, and elected by a simple majority voting approval of the Congress. Board members are elected for a term of two years, and may be re-elected;” to that the General Council Board has 15=19 board members. |
